กลุ่มผู้รับเหมาก่อสร้าง (รายย่อย) และผู้ประกอบการ จ.ภูเก็ต ยื่นหนังสือขอความเป็นธรรมต่อผู้ว่าราชการจังหวัดภูเก็ต กรณีความเดือดร้อน เรื่อง ขยายพื้นที่การทำงานแรงงานต่างด้าว และผ่อนผันการตรวจจับขณะรอเอกสาร

เมื่อวันที่ 3 สิงหาคม 2559  ที่ศาลากลางจังหวัดภูเก็ต กลุ่มผู้รับเหมาก่อสร้าง (รายย่อย) และผู้ประกอบการ จ.ภูเก็ต จำนวน 150 คน นำโดยนายวีระชัย เสดสม ได้ยื่นเดินทางมายื่นหนังสือขอความเป็นธรรมต่อผู้ว่าราชการจังหวัดภูเก็ต กรณีความเดือดร้อน เรื่อง ขยายพื้นที่การทำงานแรงงานต่างด้าว และผ่อนผันการตรวจจับขณะรอเอกสาร โดยมีนายขจรเกียรติ รักพานิชมณี รองผู้ว่าราชการจังหวัดภูเก็ต เป็นผู้รับแทน จากนั้นได้มีการส่งตัวแทนเข้าหารือ และชี้แจงประเด็นปัญหาที่เกิดขึ้น รวมถึงหาแนวทางในการแก้ไข ร่วมกับทางหน่วยงานที่เกี่ยวข้อง มีนายวิทูร ดำสาคร จัดหางานจังหวัดภูเก็ต ผู้อำนวยการศูนย์ดำรงธรรมจังหวัดภูเก็ต และหน่วยงานที่เกี่ยวข้อง

สำหรับเนื้อหาในหนังสือร้องเรียนสรุปว่า กลุ่มผู้รับเหมาก่อสร้างในจังหวัดภูเก็ต ได้รับความเดือดร้อน เรื่อง แรงงานต่างด้าว ในหลายๆ กรณีถูกเจ้าหน้าที่จับกุมอย่างหนัก ขณะนี้ปัญหาเร่งด่วน คือ แรงงานต่างด้าวไม่สามารถออกมาทำงานได้ เนื่องจากไม่มีเอกสารยังไม่เรียบร้อย อันเนื่องจากมาศูนย์บริการจดทะเบียนแรงงานต่างด้าวแบบเบ็ดเสร็จจังหวัดภูเก็ต ไม่สามารถดำเนินการออกบัตรชมพูให้กับแรงงานต่างด้าวได้ทันเวลาที่กฎหมายกำหนดคือในวันที่ 29 กรกฎาคม 2559 จึงต้องขยายเวลาออกไป และผู้ประกอบการก็ไม่สามารถขยายเขตการขออนุญาตทำงานได้ทันเวลา และการขยายเขตทำงานในปัจจุบันกำหนดให้ผู้ประกอบการรายละ 10 ตำบล และหากเกินกว่านั้นก็ต้องยื่นขอขยายเขตใหม่เพิ่มเติม ซึ่งแต่ละครั้งต้องใช้เวลา 5-7 วัน ไม่ทันกับระยะเวลาการทำงานแต่ละช่วงซึ่งมีช่วงเวลาสั้นๆ 3-5 วัน ทำให้ถูกต่อว่ากับลูกค้า รวมทั้งไม่คุ้มกับค่าเสียเวลาและค่าใช้จ่าย ทำให้ไม่สามารถที่จะเคลื่อนย้ายแรงงานไปยังพื้นที่อื่นที่นอกเหนือไปได้ จึงถือเป็นอุปสรรคในการทำงานค่อนข้างมาก เพราะผู้ประกอบการเองก็ต้องการที่จะทำให้ถูกต้อง

จากความเดือดร้อนดังกล่าวจึงอยากเรียกร้องให้หน่วยงานภาครัฐที่รับผิดชอบเข้ามาช่วยแก้ปัญหา กรณีบัตรที่รอการดำเนินการนั้น ขอให้กำหนดเวลาในการดำเนินการให้ชัดเจน และมีหลักฐานที่จะไปแสดงต่อเจ้าหน้าที่ชุดตรวจสอบ แม้จะมีการยืนยันแล้ว แต่เจ้าหน้าที่ชุดจับกุมไม่ยอมรับ ส่วนกรณีของพื้นที่ทำงานก็อยากให้กลับมาใช้รูปแบบเดิม คือ การกำหนดเขตอำเภอ แทนการกำหนดเขตหมู่บ้าน เพราะภูเก็ตพื้นที่ไม่ใหญ่ หากไม่แก้ไขตรงนี้ทางแรงงานก็จะถูกจับกุมดำเนินคดี ทั้งนี้ยืนยันว่าผู้ประกอบการพร้อมที่จะดำเนินการตามข้อกฎหมายทุกอย่าง แต่ขอความกรุณาให้ทางจังหวัดช่วยหาทางออกให้กับผู้ประกอบการด้วย เพราะขณะนี้ไม่มีใครกล้าส่งแรงงานต่างด้าวออกไปทำงาน เพราะหากเจ้าหน้าที่มาตรวจพบก็จะถูกจับกุมดำเนินคดีทันที

อย่างไรก็ตามในการประชุมร่วมกันทางผู้ประกอบการได้นำเสนอปัญหาที่เกิดขึ้น และขอให้หน่วยงานภาครัฐแก้ไขทั้งการผ่อนผันการจับกุม และการกลับมาใช้เขตพื้นที่ทำงานเป็นอำเภอเหมือนเดิม โดยหลังจากรับฟังปัญหาของผู้รับเหมาแล้ว นายขจรเกียรติ รักพาณิชมณี รองผู้ว่าราชการจังหวัดภูเก็ต กล่าวกับตัวแทนผู้ประกอบการธุรกิจรับเหมาก่อสร้างว่า ทั้งสองประเด็นที่มีการเรียกร้องนั้น ในระหว่างที่ยังไม่สามารถดำเนินการให้ได้ตามข้อเรียกร้อง ในเบื้องต้นได้มอบหมายให้จัดหางานจังหวัดภูเก็ต ช่วยดูแลปัญหาต่างๆที่เกิดขึ้น และผู้ว่าฯ ได้สั่งให้ตั้งคณะทำงานบริหารจัดการแรงงานต่างด้าวจังหวัดภูเก็ตขึ้น โดยมีผู้ว่าฯ เป็นประธาน มีรองผู้ว่าฯ ที่รับผิดชอบ ตำรวจ จัดหางาน ตัวแทนฝ่ายนายจ้าง และฝ่ายแรงงานต่างด้าว เป็นคณะทำงาน และจะได้มาประชุมร่วมกันเพื่อหาทางออกในเรื่องที่เกิดขึ้น ซึ่งเป็นข้อกฎหมาย แต่ก่อนที่จะมีการประชุมชุดใหญ่ก็จะเชิญกลุ่มผู้ประกอบการมาประชุมหารือรอบนอกกันก่อนในเร็วๆ นี้ จึงอยากให้ผู้ประกอบการสบายใจว่า ผู้ว่าฯ ทราบแล้ว และจะเร่งแก้ไขปัญหาให้โดยเร็วที่สุด
