เมื่อวันที่ 18 มีนาคม  2559  เวลา 12.00 น. ที่ บริเวณชายหาดไม้ขาว ตำบลไม้ขาว อำเภอถลาง จังหวัดภูเก็ต นายประพันธ์ ขันธ์พระแสง หัวหน้าศูนย์ดำรงธรรมจังหวัดภูเก็ต พร้อมด้วย นายธะเนต นาวาล่อง ปลัดอำเภอถลาง นายโอลิน มะลิวรรณ กำนันตำบลไม้ขาว พร้อมเจ้าหน้าที่ชุดปฏิบัติการลงพื้นที่ชายหาดบริเวณ หาดไม้ขาว ตรวจสอบกรณีมีผู้ร้องเรียนการบุกรุกที่ดินสาธารณประโยชน์

นายประพันธ์ ขันธ์พระแสง กล่าวว่า ชุดเคลื่อนที่เร็วศูนย์ดำรงธรรมจังหวัดภูเก็ต และคณะเจ้าหน้าที่จากส่วนราชการที่เกี่ยวข้อง ได้ลงพื้นที่ตรวจสอบกรณีมีผู้ร้องเรียนผ่านศูนย์รับเรื่องราวร้องทุกข์ของรัฐบาล (1111) ขอให้ตรวจสอบการบุกรุกที่สาธารณประโยชน์ (ป่าช้า) บริเวณหาดไม้ขาว ตำบลไม้ขาว อำเภอถลาง จังหวัดภูเก็ต ทางศูนย์ดำรงธรรมได้ลงพื้นที่ตรวจสอบและพบว่ามีการก่อสร้างร้านค้าจำนวน 15 หลัง มีลักษณะชั่วคราวสามารถเคลื่อนย้ายได้ โดยมีผู้ใหญ่บ้าน หมู่ที่ 4 ตำบลไม้ขาว แสดงตัวต่อเจ้าหน้าที่และรับว่าเป็นเจ้าของซุ้มและรับว่าที่ดังกล่าวเป็นพื้นที่สาธารณประโยชน์ แต่มีเอกสารยืนยันการขอใช้พื้นที่โดยการรวบรวมรายชื่อของกลุ่มคนในชุมชนเพื่อขอใช้ประโยชน์ในพื้นที่ (ป่าช้า) แต่ทางคณะเจ้าหน้าที่เห็นควรว่า ให้ผู้ใหญ่บ้าน หมู่ที่ 4 ทำหนังสือชี้แจงข้อเท็จจริงให้นายอำเภอถลาง ทราบภายใน 3 วัน ตั้งแต่วันทำการตรวจสอบ หากพบว่ามีการกระทำผิดกฎหมายการขอใช้พื้นที่สาธารณประโยชน์จริงให้ดำเนินการรื้อถอนภายใน 15 วัน แต่หากต้องการขอใช้พื้นที่สาธารณประโยชน์ต่อ ให้ผู้ใหญ่บ้านทำหนังสือขอใช้พื้นที่สาธารณะให้ถูกต้องตามระเบียบกฎหมายที่เกี่ยวข้องส่งต่ออำเภอถลาง และองค์การบริหารส่วนตำบลไม้ขาว เพื่อขอใช้พื้นที่สาธารณประโยชน์ต่อ

ในส่วนพื้นที่บริเวณพรุเจ๊ะสัน หาดไม้ขาว ตำบลไม้ขาว อำเภอถลาง เจ้าหน้าที่จากทัพเรือภาคที่ 3 ป้องกันจังหวัดภูเก็ต พร้อมคณะทำงานชุดปฏิบัติการ ลงตรวจสอบพื้นที่และพบว่ามีผู้บุกรุกใช้พื้นที่สาธารณะ บริเวณดังกล่าวจริง ซึ่งพบว่ามีผู้ก่อสร้างร้านค้าชั่วคราว จำนวน 9 ราย โดยทางคณะผู้ทำการตรวจสอบมีมติให้อำเภอถลางประสานกับองค์การบริหารส่วนตำบลไม้ขาว ดำเนินการรื้อถอนสิ่งปลูกสร้างดังกล่าวภายใน 15 วัน โดยยึดระเบียบและกฎหมายที่เกี่ยวข้องในการดำเนินการรื้อถอนอย่างเคร่งครัด และรายงานผลการดำเนินการให้ทางจังหวัดทราบต่อไป
