เมื่อเวลา 14.30 น. วันที่ 20 ธันวาคม 2557 ที่ห้องประชุมชั้น 1 ศาลากลางจังหวัดภูเก็ต นายนิสิต จันทร์สมวงศ์ ผู้ว่าราชการจังหวัดภูเก็ต ร่วมกับ พล.ต.ธีร์ณฉัฎฐ์ จินดาเงิน ผู้บัญชาการมณฑลทหารบกที่ 41 และ พ.ต.อ.จิรศักดิ์ เสียมศักดิ์ ผกก.ฝ่ายอำนวยการ ตำรวจภูธรจังหวัดภูเก็ต แถลงข่าวกรณีเจ้าหน้าที่ตำรวจภูธรฉลอง และชุดสืบสวนตำรวจภูธรจังหวัดภูเก็ต จับกุมชายฉกรรจ์ ซึ่งถูกระบุว่าเป็นทหารมณทลทหารบกที่41 และพลเรือนรวม 10 คน ก่อเหตุอุ้มและกรรโชกทรัพย์นักท่องเที่ยวชาวยูเครน 2 สามีภรรยา เหตุเกิดเมื่อเวลา 15.30 น.วันที่ 19 ธันวาคมที่ผ่านมา

พล.ต.ธีร์ณฉัฎฐ์ จินดาเงิน ผู้บัญชาการมณฑลทหารบกที่ 41 กล่าวถึงความเป็นมาของเหตุการณ์ที่เกิดขึ้น ว่า เนื่องจากมีผู้มาแจ้งข่าวกับทางเจ้าหน้าที่ฝ่ายทหารว่า อาจจะมีผู้ที่กระทำความผิดเป็นชาวต่างชาติเข้ามาหลบซ่อนอยู่ที่ จ.ภูเก็ต ลักษณะคล้ายกับอาชญากรข้ามชาติ และความร่วมมือเจ้าหน้าที่ทหารเข้าไปตรวจสอบ ในขั้นต้นพยายามเราก็พยายามให้เข้าตามระบบ แต่ผู้มาแจ้งข่าวกลัวจะเกิดความล่าช้า และกลัวผู้ที่เขากล่าวหาหลบหนี จึงขอความอนุเคราะห์เป็นกรณีพิเศษ ขอให้ทหารมาช่วยดูแลประกอบกับเขาทราบว่าเป็นช่วงของการประกาศกฎอัยการศึกซึ่งน่าจะดำเนินการได้รวดเร็วกว่า จึงได้มีการสอบถามและตรวจสอบเอกสารหลักฐานต่างๆ ที่เกี่ยวข้องจากผู้ร้องเรียนว่า เป็นผู้เสียหายจริง และได้นำไปเจอกับผู้ที่ถูกกล่าวหา ก็ได้เชิญทั้งสองฝ่ายมาพูดคุยกัน โดยใช้สถานที่ของ มทบ.41 ประจำ จ.ภูเก็ต และให้ทหารเป็นไกล่เกลี่ยหรือคนกลางหรือเป็นพยานให้

“ในการพูดคุยนั้นสองฝ่ายพูดคุยกันเอง เนื่องจากเป็นชาวยูเครนเหมือนกัน และมีล่ามแปล จนทราบว่าผู้ถูกกล่าวหาทำความผิดที่ประเทศยูเครนในลักษณะของการยืมเงินจากผู้กล่าวหาจำนวนเงินประมาณ 15 ล้านบาท และผู้ถูกกล่าวหายอมรับว่าผิดจริง จึงได้ให้ตกลงกัน โดยผู้ถูกกล่าวหายินดีที่จะชดใช้ให้ จากนั้นได้มีการนัดวิธีการจ่ายเงินกัน ซึ่งก็คิดว่าจบเรื่องแล้ว แต่ในส่วนของทหารมีเรื่องบางอย่างที่ต้องติดตาม คือ ในส่วนที่ผู้ถูกกล่าวหามีความผิดแล้วหนีมาหลบซ่อนอยู่ภูเก็ต ซึ่งเราไม่ต้องการให้ผู้ที่ทำผิดเข้ามาอยู่ในพื้นที่ จึงลองติดตามพฤติกรรมหรือเป็นข้อมูลเพื่อดำเนินการต่อไป”

พล.ต.ธีร์ณฉัฎฐ์ จินดาเงิน กล่าวว่า หลังจากที่ทั้งคู่ตกลงกันได้ในการที่จะไปเบิกเงินมาใช้หนี้ โดยทั้งสองฝ่ายได้ขอให้ทหารไปด้วยเพื่อเป็นพยานว่าได้มีการใช้หนี้กันแล้ว ซึ่งฝ่ายทหารก็ตกลง และต้องการดูพฤติกรรมด้วย จึงเข้ามาคุมเชิงข้างนอกธนาคาร อย่างไรก็ตามในช่วงที่ทำการตกลงกันนั้นทางภรรยาของผู้ถูกกล่าวหาว่าเป็นหนี้นั้น กลับมาที่บ้านและได้แจ้งความกับ สภ.ฉลอง ซึ่งอาจจะเกิดจากความกลัวหรือความไม่เข้าใจ โดยมองว่าการไปนั่งพูดคุยกันนั้นเป็นการควบคุมตัวและข่มขู่ รวมทั้งแจ้งด้วยว่าจะมีการนัดมาจ่ายเงินกันที่ธนาคารกสิกรไทยสาขาฉลอง ในระหว่างที่มีการจ่ายเงินกันนั้นเจ้าหน้าที่ทหารก็คอยดูแลอยู่ด้านนอกธนาคาร เมื่อเจ้าหน้าที่ตำรวจเห็นก็ได้เข้าควบคุมตัว ซึ่งก็เป็นไปตามหน้าที่ เพราะผู้เสียหายได้มีการแจ้งความไว้ ซึ่งเป็นการเข้าใจผิดกันเล็กน้อยว่าทหารไปอยู่เบื้องหลัง และมีการข่มขู่ ซึ่งความเป็นจริงไม่ได้เป็นเช่นนั้น แต่เป็นการปฏิบัติการทางทหารในการดำเนินการเรื่องนี้ ตามประกาศกฎอัยการศึก เป็นการดำเนินการด้านความมั่นคง เป็นงานเกี่ยวกับเรื่องความมั่นคงเป็นภัยคุกคามด้านความมั่นคงอย่างหนึ่ง เพียงแต่ว่าช่วงนั้นทางผู้มาร้องเรียนขอว่าอย่าแพล่งพลายไปก่อน กลัวว่าผู้ถูกกล่าวว่า เป็นผู้มีอิทธิพล หรือมีอำนาจเงินในการที่จะมาดำเนินการอย่างอื่นเพื่อให้ตัวเองพ้นผิด หรือหลบหนี

“จากการสอบถามผู้ถูกกล่าวหาก็ยินดี ไม่ได้ขัดขืน และไม่ได้ปฎิเสธ โดยยอมรับทุกอย่าง มีการพูดคุยกันด้วยดี มาเกิดเหตุที่มีการจับกุม ซึ่งตำรวจจับกุมกรณีของภรรยาผู้เสียหายแจ้งความ แต่ทหารก็ดำเนินการในภารกิจของทหารอยู่ จึงเกิดความไม่เข้าใจขึ้นเล็กน้อย อยากเรียนว่าอาจจะเป็นครั้งแรกในชีวิตที่ต้องอยู่ภายใต้การประกาศกฎอัยการศึก โดยเฉพาะ จังหวัดภูเก็ต ไม่มีหน่วยทหารอยู่เลย มีเพียงทหารเรือทัพเรือภาคที่ 3 ซึ่งดูแลทางทะเลเป็นหลัก จึงอาจจะเข้าใจคลาดเคลื่อนหรือไม่แม่นในกฎระเบียบของแต่ละฝ่าย ซึ่งการปฏิบัติของทหารก็ใช้ตามอำนาจกฎอัยการศึก ขณะที่ตำรวจก็มีกฎหมายในมือที่ต้องดำเนินการ จึงเกิดความไม่เข้าใจ หากคุยกันลึก ๆ ซึ่งตนได้คุยกับผู้การฯ ภูเก็ตเข้าใจกันแล้ว หากตำรวจได้รับการแจ้งความจะแจ้งผู้บังคับบัญชาฝ่ายทหารทราบ เพื่อจะประสานการปฎิบัติต่อไปในอนาคต ซึ่งไม่ได้โทษใครกัน เพราะทุกคนทำตามหน้าที่ และเกิดเข้าใจกันเท่านั้นเอง ไม่มีอะไรที่เป็นเรื่องให้เกิดข้อครหาหรือกังขากัน หรือขัดแย้งกัน ในส่วนของตำรวจก็ดำเนินคดีตามที่ผู้เสียหายแจ้งความตามกฎหมาย”

พล.ต.ธีร์ณฉัฎฐ์ กล่าวถึงกรณีที่มีข่าวว่าทางเจ้าหน้าที่ทหารไปขู่กรรโชกทรัพย์ ว่า ยืนยันว่าไม่จริง เพราะทุกครั้งในการปฏิบัติจะมีการรายงานให้ตนทราบเป็นระยะๆ และตนมั่นใจว่า ผู้ใต้บังคับบัญชาไม่ทำเช่นนั้น ยืนยันไม่มีผลประโยชน์ใด ๆ

ทางด้าน พ.ต.อ.จิรศักดิ์ กล่าวถึงกรณีดังกล่าวว่า ขณะนี้อยู่ระหว่างการดำเนินการสอบสวนข้อเท็จจริง รอการรายงานจากทาง สภ.ฉลอง

อย่างไรก็ตามภายหลังการแถลงข่าวของเจ้าหน้าที่รัฐแล้วเสร็จ ทางด้านนายประวัตร์ เอียดยาว น.ส.อรนุช ติยพงศ์พัฒนา นายเขมติชัย ปันเสาร์ นายบันดาล อินมัง และนายสมพร ชัยสิทธิ์ พลเรือนที่ตกเป็นผู้ถูกกล่าวหาในคดีกักขังหน่วงเหนี่ยวและกรรโชกทรัพย์ ก็ได้เปิดแถลงข่าวกับเหตุการณ์ที่เกิดขึ้น หลังจากได้รับการประกันตัวจากศาลออกมาต่อสู้คดีวงเงินคนละ 1 แสนบาท โดยกล่าวว่า เหตุการณ์ที่เกิดขึ้นไม่ได้เป็นจริงอย่างที่สื่อนำเสนอหรือตำรวจแจ้งข้อหา ซึ่งแต่ละคนได้เข้ามาช่วยประสานงานให้กับทหารที่ไปดูแลความปลอดภัยของผู้เสียหาย และไม่เคยมีการอุ้มสองสามีภรรยาชาวยูเครนไปรีดเอาเงินตามที่ถูกกล่าวหาแต่อย่างใด โดยมีหน้าที่เป็นเพียงล่ามแปลภาษาให้กับผู้เสียหายที่เป็นชาวยูเครน และในช่วงที่นำตัวผู้เสียหายไปที่ป่าคลอกนั้นก็ไม่ได้มีการบังคับขู่เข็ญ แต่ไม่เข้าใจว่าทำไมจึงมีการแจ้งความ ซึ่งสร้างความเสียหายให้กับพวกตนเป็นอย่างมาก
