ผู้บัญชาการสำนักคดีคุ้มครองผู้บริโภคและสิ่งแวดล้อม กรมสอบสวนคดีพิเศษเข้าแจ้งข้อกล่าวหาบุกรุกพื้นที่อุทยานแห่งชาติสิรินาถ อ.ถลาง จ.ภูเก็ต ต่อนักโทษรายหนึ่งในเรือนจำจังหวัดภูเก็ต
เมื่อวันที่ 29 มกราคม  2559  พ.ต.ท.ประวุธ วงศ์สีนิล ผู้บัญชาการสำนักคดีคุ้มครองผู้บริโภคและสิ่งแวดล้อม กรมสอบสวนคดีพิเศษ (ดีเอสไอ) เปิดเผยภายหลัง พร้อมด้วยพนักงานอัยการ และพนักงานสอบสวน เข้าแจ้งข้อกล่าวหาบุกรุกพื้นที่อุทยานแห่งชาติสิรินาถ อ.ถลาง จ.ภูเก็ต ต่อนักโทษรายหนึ่งในเรือนจำจังหวัดภูเก็ต ว่า สืบเนื่องจากกรมอุทยานแห่งชาติสัตว์ป่า และพันธุ์พืช ได้ร้องทุกข์ต่อดีเอสไอ กรณีการบุกรุกอุทยานแห่งชาติสิรินาถ และจากการสอบสวนที่ดินแปลงหนึ่ง เนื้อที่ประมาณ 92 ไร่ ซึ่งมีสภาพเป็นป่าและเขา โดยยังไม่มีสิ่งปลูกสร้าง พบว่า ที่ดินแปลงนี้มีการใช้ ส.ค.1 ปลอมมาอ้างเพื่อออกโฉนดที่ดิน ความชัดเจนของการตรวจสอบ คือ ส.ค.1 ดังกล่าว เป็นที่ตั้งของบ้านพักอาศัย และบุคคลซึ่งเป็นเจ้าของ ส.ค.1 ปัจจุบันยังอยู่ที่เดิมซึ่งเป็นชุมชน ไม่ใช่ที่เกิดเหตุ และมีความชัดเจนมาก เมื่อพบการกระทำผิดดังกล่าว จึงได้ดำเนินคดีกับผู้ที่เกี่ยวข้อง โดยเฉพาะเอกชนที่เข้าไปยึดถือครอบครอง จำนวน 6 ราย โดยหนึ่งในนั้นคือผู้ที่ถูกขังอยู่ในเรือนจำจังหวัดภูเก็ต จึงได้นำพนักงานสอบสวนและพนักงานอัยการมาแจ้งข้อกล่าวหาให้ได้รับทราบ ซึ่งทางผู้ถูกกล่าวหาแจ้งว่าจะนำหลักฐานที่มีอยู่มาชี้แจงต่อทางเจ้าหน้าที่ต่อไป โดยในกรณีนี้ยังเหลือผู้ต้องหาอีก 1 คนซึ่งเป็นชาวต่างชาติ ทางเจ้าหน้าที่ได้มีการประสานไปกับทางภรรยาแล้วว่าให้มารับทราบข้อกล่าวหา โดยกล่าวหาว่า บุกรุกอุทยานแห่งชาติฯ บุกรุกป่าสงวนแห่งชาติ บุกรุป่าตาม พ.ร.บ.ป่าไม้ และบุกรุกที่ดินของรัฐตามประมวลกฎหมายที่ดิน ซึ่งในจำนวนดังกล่าวยังมีนิติบุคคลอีก 1 รายด้วย

“การดำเนินการของทางดีเอสไอนั้น กรณีที่เป็นกลุ่มข้าราชการก็จะมีการชี้มูลให้กับทาง ป.ป.ช. ซึ่งทราบว่าขณะนี้ทาง ป.ป.ช.ได้มีการรับเรื่องของข้าราชการที่มีส่วนเกี่ยวข้องกับการออกเอกสารสิทธิที่ไม่ถูกต้องไปไต่สวนแล้ว ขณะที่ทางดีเอสไอจะสรุปในส่วนของหลักฐานที่พบส่งเพิ่มเติมไปประกอบ เนื่องจากการตรวจทางด้านนิติวิทยาศาสตร์พบว่า มีการปลอมเอกสาร ส.ค.1 ทั้งฉบับและนำมาอ้างในการออกเอกสารสิทธิโดยมิชอบ เบื้องต้นมีข้าราชการที่เกี่ยวข้องหลายคน แต่อยู่ระหว่างการพิจารณาผู้ที่อยู่ในระดับสูงขึ้นไป เนื่องจากมีเนื้อหาของการบรรยายที่ขัดกับข้อเท็จจริงที่อยู่ในพื้นที่เกี่ยวกับเรื่องการทำประโยชน์ เนื่องจากทางเจ้าหน้าที่ระดับล่างได้เสนอไปแล้วว่ามีการทำประโยชน์ไม่เต็มทั้งแปลง โดยยังมีพื้นที่ป่าประมาณ 50% แต่ข้อเท็จจริงนี้ก็ถูกนำเสนอไปสู่คนที่มีอำนาจลงนามซึ่งเป็นระดับผู้ว่าราชการจังหวัด แต่มีการเขียนข้อเท็จจริงมาหักล้างกับความเห็นของเจ้าหน้าที่ที่เสนอขึ้นไป
