ภูเก็ตพบนิติบุคคล 4 ราย ประกอบธุรกิจโดยมีลักษณะใช้คนไทยเป็นตัวแทนอำพราง

เมื่อวันที่ 6 สิงหาคม  2558 นายนิมิตร ฆังคะจิตร พัฒนาธุรกิจการค้าจังหวัดภูเก็ต กล่าวในการโครงการผู้ว่าราชการจังหวัดภูเก็ตพบสื่อมวลชน ครั้งที่ 11/2558 ที่ห้องประชุมศาลากลางจังหวัดภูเก็ต ซึ่งมีนายนิสิต จันทร์สมวงศ์ ผู้ว่าราชการจังหวัดภูเก็ต เป็นประธาน  เกี่ยวกับการตรวจสอบนิติบุคคลในพื้นที่จังหวัดภูเก็ต

การที่กรมพัฒนาธุรกิจการค้า ดำเนินการตรวจสอบนิติบุคคล ในพื้นที่จังหวัดภูเก็ต ตามแผนปฏิบัติการแก้ปัญหาการประกอบธุรกิจโดยใช้คนไทยเป็นตัวแทนอำพราง ระหว่างวันที่ 12-17 กรกฎาคม 2558 โดยร่วมกับกรมการท่องเที่ยวและกรมสอบสวนคดีพิเศษ ตามโครงการตรวจสอบธุรกิจประจำปี 2558 จากผู้ประกอบธุรกิจที่เกี่ยวข้องกับการท่องเที่ยว 6 ประเภท ได้แก่ ภัตตาคาร ร้านอาหารเครื่องดื่ม จำนวน 8 ราย ให้เช่า ขาย ซื้อ ดำเนินงานด้านอสังหาริมทรัพย์ จำนวน 13 ราย ตัวแทน นายหน้า ซื้อขายอสังหาริมทรัพย์ จำนวน 2 ราย ธุรกิจท่องเที่ยว จำนวน 16 ราย ให้เช่ายานพาหนะ จำนวน 2 ราย และสปา จำนวน 2 ราย รวม 43 ราย
โดยในวันที่ 16 กรกฎาคม 2558 เป็นการออกตรวจตามนโยบายและข้อสั่งการของนายนิสิต จันทร์สมวงศ์ ผู้ว่าราชการจังหวัดภูเก็ต ให้เจ้าหน้าที่ผู้รับผิดชอบในระดับจังหวัด ได้แก่ เจ้าหน้าที่จากสำนักงานการท่องเที่ยวและกีฬาจังหวัดภูเก็ต สำนักงานทะเบียนธุรกิจนำเที่ยวและมัคคุเทศก์สาขาภาคใต้ เขต 2 จังหวัดภูเก็ต สำนักงานพัฒนาธุรกิจการค้าจังหวัดภูเก็ต กรมสอบสวนคดีพิเศษ ภาค 8 และตำรวจท่องเที่ยวจังหวัดภูเก็ต เข้าร่วมตรวจสอบโดยบูรณาการร่วมกับเจ้าหน้าที่ของกรมการท่องเที่ยว กรมสอบสวนคดีพิเศษ กรมพัฒนาธุรกิจการค้า เพื่อตรวจสอบธุรกิจนำเที่ยวและธุรกิจที่เกี่ยวข้อง โดยเฉพาะเพื่อป้องกันและปราบปรามการประกอบธุรกิจกลุ่มเป้าหมายที่มีลักษณะใช้คนไทยเป็นตัวแทนอำพราง
ผลการตรวจสอบในเบื้องต้น สรุป ได้ว่า 1. มีพฤติกรรมการประกอบธุรกิจเข้าข่ายประกอบธุรกิจโดยใช้คนไทยเป็นตัวแทนอำพรางจำนวน 4 ราย (ธุรกิจท่องเที่ยว จำนวน 3 ราย ธุรกิจอสังหาริมทรัพย์ จำนวน 1 ราย) 2. ส่งหนังสือเรียกชี้แจงข้อเท็จจริงและส่งเอกสารประกอบ เนื่องจากไม่พบกรรมการผู้มีอำนาจจำนวน 37 ราย และ 3. ตรวจสอบที่ตั้งเพิ่มเติม เนื่องจากนิติบุคคลไม่มีที่ตั้งตามที่จดทะเบียนไว้ จำนวน 2 ราย
สำหรับนิติบุคคลจำนวน 4 ราย ซึ่งเบื้องต้นตรวจสอบจากข้อเท็จจริงจากการให้ถ้อยคำของกรรมการและผู้ถือหุ้น พบว่ามีพฤติกรรมการประกอบธุรกิจโดยมีลักษณะใช้คนไทยเป็นตัวแทนอำพราง ซึ่งกรมพัฒนาธุรกิจการค้าจะทำการตรวจสอบบัญชีและเอกสารประกอบการลงบัญชี เพื่อรวบรวมข้อเท็จจริง และเอกสารพยานหลักฐานเพิ่มเติม ก่อนพิจารณาส่งกรมสอบสวนคดีพิเศษดำเนินการต่อไป
