เจ้าหน้าที่สำนักทรัพยากรป่าไม้ที่ 12 กระบี่สนธิกำลังทหารเรือ ตำรวจในพื้นที่ลงตรวจสอบที่ดินหาดฟรีดอมหลังอธิบดีกรมที่ดินมีคำสั่งเพิกถอนเอกสารสิทธิ์แต่พบยังมีผู้ครอบครองพร้อมเก็บเงินนักนักเที่ยวที่ใช้พื้นที่ขึ้นลงชายหาด

เมื่อวันที่ 25 พฤศจิกายน  2559  สำนักจัดการทรัพยากรป่าไม้ที่ 12 กระบี่ นำโดยนายบุญสืบ สมัครราช ผู้อำนวยการสำนักจัดการทรัพยากรป่าไม้ที่ 12 สาขากระบี่ สนธิกำลังร่วมกับทัพเรือภาคที่ 3 หน่วยป้องกันรักษาป่าที่ ภูเก็ต 1 และภูเก็ต 2) หัวหน้าสายตรวจฯ ที่ 2 ประจำจังหวัดพังงา, ภูเก็ต เจ้าหน้าที่ตำรวจ สภ.กะรน และหน่วยงานที่เกี่ยวข้อง ลงตรวจสอบที่ดินหาดฟรีดอม

กรณีได้รับการร้องเรียนว่า มีการตั้งจุดเก็บเงินทางขึ้น-ลง หาดฟรีดอม ในเขตป่าสงวนแห่งชาติ “ป่าเทือกเขานาคเกิด” หมู่ที่ 1 ต.กะรน อ.เมืองภูเก็ต โดยการอ้างกรรมสิทธิ์โฉนดที่ดินเลขที่ 98414 เนื้อที่จำนวน 45 ไร่ และ 98415 เนื้อที่ จำนวน 19 ไร่ 3 งาน ซึ่งทางอธิบดีกรมที่ดินได้มีคำสั่ง ให้เพิกถอนโฉนดที่ดินดังกล่าวไปแล้วตามคำสั่งที่ 1280/2559 ลงวันที่ 12 พฤษภาคม 2559 และให้ที่ดินแปลงดังกล่าวกลับเป็นที่ดินของรัฐ พบมีผู้ทำหน้าที่ในการเก็บเงินจากผู้ที่ขึ้นลงชายหาดจริง จึงได้ควบคุมตัวไว้ และนำส่งพนักงานสอบสวน สภ.กะรน อ.เมืองภูเก็ต ตรวจสอบภายในที่ดินแปลงดังกล่าวพบสิ่งปลูกสร้างจำนวน 4 หลัง ซึ่งยังไม่ได้มีการรื้อถอน แม้ว่าจะครบกำหนดที่มีการแจ้งให้ผู้ครอบครองทำการรื้อถอนภายใน 30 วัน นับตั้งแต่วันที่ 8 กันยายน 2559 ระหว่างนั้นได้มีนายเอกชัย แซ่อิ๋ว อายุ 35 ปี ซึ่งอ้างกรรมสิทธิ์ในที่ดินแปลงดังกล่าว พร้อมด้วยนางเบญจา เศวตวรรณ มารดา ได้นำเอกสารสิทธิโฉนดที่ดินเลขที่ 98414 และ 98415 มาแสดงต่อเจ้าหน้าที่ และพยายามอธิบายว่า กระบวนการดำเนินการทางกฎหมายนั้นยังไม่สิ้นสุด ดังนั้นจึงทำให้เขายังคงมีกรรมสิทธิ์ในที่ดินดังกล่าว

นายบุญสืบ สมัครราช ผู้อำนวยการสำนักจัดการทรัพยากรป่าไม้ที่ 12 สาขากระบี่ กล่าวว่า การลงพื้นที่นั้น เพื่อตรวจพื้นที่หลังจากกรมที่ดินได้มีคำสั่งเพิกถอนโฉนดที่ดินเลขที่ 98414 และ 98415 เนื้อที่รวมประมาณ 65 ไร่เศษ และก่อนหน้านี้ก็ได้มีการทำหนังสือแจ้งให้กับทางผู้ครอบครองได้รับทราบคำสั่งดังกล่าวแล้ว พร้อมแจ้งเป็นหนังสือให้ผู้ครอบครองออกจากพื้นที่ภายใน 30 วัน นับตั้งแต่วันที่ 8 กันยายน 2559 และทางกรมป่าไม้ก็ได้มีคำสั่งให้สำนักจัดการทรัพยากรป่าไม้ที่ 12 สาขากระบี่ เข้ามาดำเนินการตามอำนาจหน้าที่ คือ มาตรวจสอบพื้นที่ว่ามีการดำเนินการอะไรบ้าง ซึ่งพบว่ามีการเก็บตั๋วค่าเข้าพื้นที่เพื่อลงไปยังชายหาด โดยสามารถจับกุมผู้ต้องหาไว้ได้ 1 คน พร้อมตรวจสอบพื้นที่ทั้งหมด และรวบรวมพยานหลักฐานต่างๆ เพื่อร้องทุกข์กล่าวโทษต่อไป

นายบุญสืบ กล่าวด้วยว่า หลังจากที่ดำเนินการตามกระบวนการต่างๆ เรียบร้อยแล้ว ที่ดินแปลงดังกล่าวก็จะกลับคืนเป็นที่ดินของรัฐ และประชาชนก็สามารถใช้ประโยชน์ร่วมกันได้ สามารถขึ้นลงชายหาดได้อย่างอิสระไม่มีการเก็บเงิน นอกจากนี้ก็จะมีทางเจ้าหน้าที่หน่วยรักษาป่าภูเก็ต 2 เข้าตรวจสอบและดูแลพื้นที่ หากพบว่ามีการเรียกเก็บเงินก็จะทำการจับกุมดำเนินคดี ส่วนกรณีที่ทางผู้อ้างสิทธิ์ครอบครองจะร้องต่อศาลปกครอง ก็เป็นสิ่งที่เขาสามารถทำได้ตามกระบวนการ หรือจะแจ้งความตนก็สามารถทำได้ แต่ขณะนี้ในส่วนของกรมที่ดินได้มีคำสั่งให้เพิกถอนโฉนดที่ดินแล้วในส่วนของตนก็ดำเนินการไปตามอำนาจหน้าที่ และจากการตรวจสอบโดยจับจีพีเอส พบว่าพื้นที่นี้อยู่ในเขตป่าสงวนแห่งชาติ ซึ่งในการออกเอกสารสิทธิในพื้นที่ป่าสงวนมีขั้นตอนอยู่แล้ว แต่หากมีการออกไม่ชอบก็สามารถเพิกถอนได้

ขณะที่นายเอกชัย แซ่อิ๋ว อายุ 35 ปี ผู้ครอบครองโฉนดที่ดินแปลงดังกล่าว ได้ขอความเป็นธรรมกับสื่อว่า สำหรับที่ดินทั้งสองแปลงนั้นได้ซื้อมาจากผู้ครอบครองเดิม เป็นทอดที่ 2 เมื่อประมาณต้นปี 2553 และขอออกโฉนดได้สำเร็จเมื่อวันที่ 12 เมษายน 2554 และได้มีการนำไปจำนองไว้เป็นเงินจำนวน 500 ล้านบาท เพื่อนำมาใช้ในการแก้ปัญหากรณีข้อพิพาทที่เกิดขึ้นกับที่ดินแปลงนี้ ซึ่งยังมีเรื่องอยู่ในชั้นศาล โดยตนมีอาชีพรับทำป้ายโฆษณาและ ไม่ได้เป็นเป็นนอมินีในการถือครองโฉนดหาดฟรีดอมตามที่ตกเป็นข่าว ซึ่งหลังจากนี้ภายในเดือนธันวาคมนี้ จะยื่นเรื่องต่อศาลปกครองให้เพิกถอนคำสั่งของอธิบดีกรมที่ดินที่ได้สั่งเพิกถอน โฉนดทั้ง 2 แปลง เพื่อให้กลับมาเป็นของตน และยืนยันว่าเราได้มาถูกต้องตามขั้นตอน
