เมื่อวันที่ 6 กรกฎาคม  2558  เวลา 10.00 น. ที่ห้องประชุม ปภ.เขต 18 ภูเก็ต นายอำพล วงศ์ศิริ เลขาธิการคณะกรรมการคุ้มครองผู้บริโภค พ.ต.อ. อังกูร คล้ายคลึง รองผู้บังคับการปราบปรามการกระทำความผิดเกี่ยวกับการคุ้มครองผู้บริโภค นายสายัณห์ ชนะชัยวงศ์ นายอำเภอกะทู้ ข้าราชการที่เกี่ยวข้องร่วมประชุมหารือเพื่อหาข้อสรุปการแก้ไขปัญหาร้องเรียนโครงการ ACE1 Condo โดยมีผู้บริโภคที่ได้รับความเดือดร้อนเข้าร่วม

นายอำพล วงศ์ศิริ กล่าวว่า ตามที่มีกลุ่มผู้ร้องเรียนได้ร้องเรียนผ่านศูนย์ดำรงธรรมจังหวัดภูเก็ตและผู้ร้องอีกกลุ่มหนึ่งได้ร้องเรียนต่อสำนักงานคณะกรรมการคุ้มครองผู้บริโภค (สคบ.) ว่าเมื่อปี 2556 ได้ทำสัญญาจองซื้ออาคารชุดโครงการ ACE1 Condo กับบริษัทเดอะไนน์ พร็อพเพอร์ตี้ (ป่าตอง) จำกัด ตั้งอยู่ในเขตอำเภอป่าตอง จังหวัดภูเก็ต กลุ่มผู้ร้องเรียนได้ชำระเงินให้กับบริษัทฯ ไปแล้วเฉลี่ยคนละ 400,000 บาท (สี่แสนบาทถ้วน) แต่ปรากฏว่ากระทั่งปัจจุบันบริษัทฯ ไม่มีความคืบหน้าในโครงการก่อสร้าง กลุ่มผู้ร้องเรียนจึงประสงค์ขอเงินจองและเงินดาวน์คืน โดยได้ร้องเรียนผ่านสื่อมวลชนในหลายแขนง ซึ่งข้อเท็จจริงดังกล่าวจังหวัดภูเก็ตได้ดำเนินการไกล่เกลี่ยอยู่ แต่ยังไม่ได้ข้อยุติแต่อย่างใด อย่างไรก็ตามโครงการ ACE1 Condo มีกำหนดแล้วเสร็จและส่งมอบในวันที่ 30 เมษายน 2558 แต่ไม่มีความคืบหน้าในการก่อสร้าง ทำให้ผู้บริโภคจำนวน 21 รายร้องเรียนผ่านสำนักงานคณะกรรมการคุ้มครองผู้บริโภค หรือ สคบ. เพื่อขอเงินคืน โดยทาง สคบ. ได้ประสานกับบริษัทเดอะ ไนน์ พร็อบเพอร์ตี้ ป่าตองจำกัด เพื่อขอเงินคืนให้กับผู้บริโภค แต่ไม่ได้รับการตอบรับ สคบ. จึงร่วมกับ กองบังคับการปราบปรามการกระทำความผิดเกี่ยวกับการคุ้มครองผู้บริโภค และสถานีตำรวจภูธรกะทู้ เตรียมดำเนินการเอาผิดกับผู้ประกอบการทางอาญา ได้แก่ ข้อหาฉ้อโกงประชาชน การกระทำผิดด้านการคุ้มครองผู้บริโภคด้านการโฆษณา พ.ร.บ. คอมพิวเตอร์ พ.ร.บ.จัดสรรที่ดิน ด้าน พ.ต.อ. อังกูร คล้ายคลึง รองผู้บังคับการปราบปรามการกระทำความผิดเกี่ยวกับการคุ้มครองผู้บริโภค ขอความร่วมมือผู้บริโภคที่ได้รับความเดือดร้อนและต้องการขอเงินคืนทั้งหมด เข้าแจ้งความกับ สถานีตำรวจภูธรกะทู้ ให้แล้วเสร็จภายใน 7 วัน เพื่อให้เจ้าหน้าที่สรุปสำนวนและดำเนินการเอาผิดทางอาญากับผู้ประกอบการต่อไป
