ผู้ว่าฯ ตั้งคณะทำงานเร่งสำรวจแนวเขตที่ดินหน้าหาดราไวย์ก่อนออก นสล.ให้ชาวไทยใหม่ใช้ร่วมกัน

ผลการประชุมคลี่คลายปัญหาข้อพิพาทระหว่างชาวไทยใหม่กับบริษัทบารอนฯ ผู้ถือเอกสารสิทธิ์ พบไม่มีทางสาธารณะในที่ดินพิพาท ขณะที่ผู้ว่าราชการจังหวัดภูเก็ต ตั้งคณะทำงานขึ้นมา 1 ชุด มีรองผู้ว่าฯ เป็นประธาน ลงพื้นที่วางแนวเขตที่ดินด้านหน้าบริษัทบารอนฯ เพื่อให้เกิดความชัดเจนเรื่องขอบเขตที่ดินสาธารณะกับที่ดินของเอกชน ก่อนออก นสล. เพื่อให้ชาวไทยใหม่ใช้ประโยชน์ร่วมกัน
เมื่อวันที่ 2 กุมภาพันธ์  2559  เวลา 12.30 น. ที่ห้องประชุมศาลากลางจังหวัดภูเก็ต นายจำเริญ ทิพญพงศ์ธาดา ผู้ว่าราชการจังหวัดภูเก็ต แถลงสรุปผลการประชุมร่วมกับ พล.อ.สุรินทร์ พิกุลทอง ประธานคณะกรรมการแก้ไขปัญหาความมั่นคงในที่อยู่อาศัยพื้นที่ทำกินและพื้นที่ทางจิตวิญญาณของชุมชนชาวเล ,รองผู้ว่าราชการจังหวัดภูเก็ต  พล.ต.ธีร์ณฉัฎฐ์ จินดาเงิน ผู้บัญชาการมณฑลทหารบกที่ 41 , พ.ต.ท.ประวุธ วงศ์สีนิล ผู้บัญชาการสำนักคดีคุ้มครองผู้บริโภคและสิ่งแวดล้อม กรมสวบสวนคดีพิเศษ , พล.ต.ต.ธีระพล ทิพย์เจริญ ผู้บังคับการตำรวจภูธรจังหวัดภูเก็ต ผู้แทนบริษัทบารอน เวิลด์ เทรด จำกัด ผู้แทนชาวไทยใหม่ราไวย์ ฯลฯ ในการคลี่คลายปัญหาข้อพิพาทระหว่างกลุ่มชาวไทยใหม่ราไวย์ กับบริษัทบารอน เวิลด์ เทรด จำกัด ผู้ถือครองเอกสารสิทธิ์ ในพื้นที่พิพาท ที่ดินรอยต่อจากชุมชนชาวไทยใหม่ราไวย์ หมู่ 2 ต.ราไวย์ ไปยังที่ตั้งศาลาบาลัยเพื่อประกอบพิธีทางศาสนาของชาวไทยใหม่ ซึ่งต้องเดินผ่านที่ดินของบริษัท บารอนฯ

จากการประชุมได้ข้อสรุปดังนี้ ประเด็นแรก เมื่อช่วงเช้าที่ผ่านมา ตนได้สั่งการให้เจ้าพนักงานที่ดิน ร่วมกับนายกเทศมนตรีตำบลราไวย์ และตัวแทนบริษัท บารอนฯ ไปตรวจสอบแนวเขตที่ดินด้านหน้าชายหาด ว่าหลักแนวเขตของที่ดินนั้น มีสถานะเป็นอย่างไร เพื่อนำมาประกอบการพิจารณา ซึ่งในหลักการชาวไทยใหม่ มีความประสงค์ขอให้ศาลาบาลัย ตั้งอยู่ที่เดิม สามารถเดินจากชุมชนที่ชาวไทยใหม่อยู่อาศัยไปทำพิธีกรรมที่บาลัยได้ เพราะฉะนั้นประเด็นคือ เส้นทางที่ใช้เดินไปยังศาลาบาลัยนั้น ที่ผ่านมา เดินผ่านที่ของบริษัท บารอนฯ เข้าไป ปัญหาที่เกิดบริษัทบารอนฯ ต้องการพัฒนาที่ดิน แต่เส้นทางที่เดินนั้น ไม่ปรากฏในโฉนดที่ดินว่าเป็นเส้นทางสาธารณะ เพราะฉะนั้นการพูดคุยวันนี้ เป็นเรื่องการพิสูจน์ข้อเท็จจริง แต่วันนี้ในเบื้องต้นเราก็จะให้เจ้าพนักงานที่ดิน ซึ่งตนได้แต่งตั้งรองผู้ว่าราชการจังหวัดภูเก็ต นายประเจียด อักษรธรรมกุล เป็นหัวหน้าคณะทำงานร่วมกับหน่วยงานที่เกี่ยวข้องและตัวแทนพื้นที่ลงไปวางแนวเขตที่ดินด้านหน้าของบริษัท บารอนฯ ให้มีความชัดเจน ซึ่งทราบเบื้องต้นว่าจากแนวเขตที่ดินของบริษัทบารอนฯ มีระยะห่างจากพื้นที่หน้าหาดประมาณ 3 เมตรกว่า ซึ่งสามารถเดินผ่านได้ เพราะเป็นพื้นที่สาธารณะโดยสภาพ เพราะฉะนั้นจากจุดที่ชาวไทยใหม่ไปยังจุดศาลาบาลัย สามารถเดินได้ในพื้นที่สาธารณะ แม้ว่าบางช่วงอาจจะแคบมีพื้นที่ประมาณ 1 เมตรกว่า ซึ่งต้องไปดูข้อเท็จจริงในพื้นที่อีกครั้ง ว่าเป็นอย่างไร วันนี้ก็สามารถที่จะคลี่คลายส่วนนี้ไปได้ส่วนหนึ่ง โดยให้รองผู้ว่าราชการจังหวัดลงไปดำเนินการหลังจากนี้เพื่อให้เกิดความชัดเจน
ประเด็นที่ 2 พื้นที่ด้านหน้าทั้งหมด ซึ่งเป็นพื้นที่สาธารณะ ตนจะดำเนินการให้ออก หนังสือสำคัญที่หลวง เพื่อจะได้มีความชัดเจนเรื่องขอบเขตที่ดินสาธารณะ กับที่ดินของเอกชนจะได้ขจัดปัญหาในอนาคตต่อไป ซึ่งอันนี้ก็จะเป็นการดำเนินการในขั้นตอนที่ 2

ประเด็นที่ 3 เป็นข้อเสนอของบริษัท บารอนฯ เสนอที่ดินที่อยู่ติดกับชุมชนที่อยู่อาศัยของชาวไทยใหม่ จำนวน 2 งาน เป็นข้อเสนอเดิม ที่จะให้กับพี่น้องชาวเลได้ใช้ทำกิจกรรมทางด้านศาสนาหรืออื่นๆ ได้ แต่เนื่องจากว่า บริษัทได้เสนอให้ย้ายศาลาบาลัยจากจุดเดิมเข้ามาอยู่ในพื้นที่ตรงนี้ ซึ่งไม่ตรงกับความต้องการของชาวไทยใหม่ สรุปคือบาลัยอยู่ที่เดิม ส่วนเงื่อนไขที่จะยกที่ให้ 2 งาน ก็เป็นข้อเสนอว่า ให้ไปอยู่ในโซนของพื้นที่บาลัยได้หรือไม่ ทั้งนี้อยากให้ชาวไทยใหม่ได้มีพื้นที่ทำกิจกรรมทางศาสนาหรืออื่นๆ ได้ ซึ่งในประเด็นนี้ทางบริษัทบารอนฯ ก็จะรับไปพิจารณา

ประเด็นที่ 4 ซึ่งเป็นประเด็นตามหลักข้อกฎหมาย เมื่อได้ข้อยุติแบบนี้ก็อยู่ที่ชาวไทยใหม่ เห็นว่าพอใจหรือไม่ ชาวไทยใหม่สามารถใช้สิทธิ์ทางกระบวนการยุติธรรม คือไปดำเนินการฟ้องร้องต่อศาลปกครองให้คุ้มครองชั่วคราวหรือให้มีการพิสูจน์ด้านการออกเอกสารสิทธิ์ของกรมที่ดิน ซึ่งอ้างว่าไม่ถูกต้องว่ามีทางสาธารณะก็ให้ไปดำเนินการตามกระบวนการยุติธรรม ซึ่งบริษัทบารอนฯ ก็สามารถที่จะใช้กระบวนการยุติธรรมในการที่จะปกป้องเอกสิทธิ์ของตัวเองได้เหมือนกัน ก็ไปว่ากันตามกระบวนการยุติธรรม

“กรณีที่ทางบริษัทต้องการดำเนินการต่อ ในการเข้าไปพัฒนาที่ดิน ต้องใช้สิทธิ์ทางกระบวนการยุติธรรม ถ้าชาวไทยใหม่เดินผ่านที่ดินของบริษัทเขาไป ก็เห็นว่าไม่สะดวกในการพัฒนาที่ดินตามเอกสิทธิ์ของเขา บริษัทจึงเสนอให้ที่ด้านข้างจำนวน 2 งาน แล้วให้ย้ายบาลัย ซึ่งก็ไม่ตรงกับความต้องการของชาวไทยใหม่ เพราะฉะนั้น ก็ให้ทั้งสองฝ่ายกลับเข้าสู่กระบวนการยุติธรรม ให้ศาลได้พิจารณาต่อไป ส่วนเส้นทางที่ถูกปิดไปก่อนหน้านี้และมีการเปิดประมาณ 3 เมตรครึ่ง ขณะนี้ตนได้ขอให้ทางบริษัทบารอนฯ เปิดให้ชาวไทยใหม่ใช้ไปพลางๆ ก่อน จนกว่าจะมีการรังวัดแนวเขตเส้นทางหน้าหาดแล้วเสร็จ ในระหว่างนี้ชาวไทยใหม่ก็ยังใช้เส้นทางเดินไปยังที่ตั้งศาลาบาลัยได้ โดยไม่มีการละเมิดสิทธิ์” นายจำเริญ กล่าว
