กรมอุทยานแห่งชาติฯ ร่วมกับ DSI แถลงข่าวผู้บุกรุกพื้นที่อุทยานและป่าสงวนแห่งชาติฯ ศาลภูเก็ตตัดสินจำ ปลอมโฉนด ปรับกว่า 9 ล้านบาท

เมื่อวันที่ 1 มิถุนายน  2559 เวลา 11.00 น.  ณ ห้องประชุมสถาบันประชารัฐพิทักษ์ทะเล อุทยานแห่งชาติสิรินาถ จังหวัดภูเก็ต นายธัญญา เนติธรรมกุล อธิบดีกรมอุทยานแห่งชาติ สัตว์ป่าและพันธุ์พืช นายณัฐพล รัตนพันธุ์ ผู้อำนวยการส่วนจัดการอุทยานแห่งชาติทางทะเล นายกิตติพัฒน์ ธาราภิบาล หัวหน้าอุทยานแห่งชาติสิรินาถ พร้อมด้วย  พ.ต.ท.พงศ์อินทร์ อินทรขาว รองอธิบดีกรมสอบสวนคดีพิเศษ (DSI)  พ.ต.ท.ประวุธ วงศ์สีนิล ผู้บัญชาการสำนักคดีคุ้มครองผู้บริโภคและสิ่งแวดล้อม ได้ร่วมกันแถลงผลการดำเนินร่วมกันในคดีกัลป์ผู้บุกรุกพื้นที่อุทยานแห่งชาติสิรินาถ และป่าสงวนแห่งชาติป่าเขารวก-ป่าเขาเมือง จำนวน 5 คดี ในพื้นที่ หมู่ที่2 และหมู่ที่3 ตำบลสาคู อำเภอถลาง จังหวัดภูเก็ต

นายธัญญา เนติธรรมกุล ได้กล่าวว่า จากคำสั่ง คสช.ที่ 64/2557 เรื่อง การปราบปรามและหยุดยั้งการบุกรุกทำลายทรัพยากรป่าไม้ และนโยบายของรัฐบาลที่จะทวงคืนผืนป่าให้กลับมาเป็นของรัฐ โดยได้ตรวจสอบพบว่ามีกลุ่มนายทุนรายใหญ่ได้เข้ามายึดพื้นที่อุทยานสิรินาถ บริเวณหมู่ที่ 2 และ 3 ตำบลสาคู อำเภอถลาง จังหวัดภูเก็ต โดยมีการออกเอกสารสิทธิไปแล้วจำนวน 4 แปลง และอยู่ระหว่างการยื่นคำขอออกโฉนดจำนวน 5 แปลง ในส่วนของการออกเอกสารสิทธิไปแล้ว ได้ส่งเรื่องให้กรมสอบสวนคดีพิเศษรับเป็นคดีพิเศษ

ขณะนี้ได้ดำเนินการแจ้งข้อกล่าวหาไป 1 คดี (2 แปลง) ส่วรอีก 1 คดี (2 แปลง) อยู่ระหว่างการรวบรวมพยานหลักฐาน ในส่วนที่ได้มีการยื่นคำขอออกโฉนดที่ดินจำนวน 5 แปลง โดยสำนักงานที่ดินจังหวัดภูเก็ต สาขาถลาง ได้ตรวจพบว่าหลักฐาน ส.ค.1 ที่นำมาออกเอกสารสิทธิเป็นหลักฐานของที่ดินแปลงอื่น จึงได้ถอนคำขอและที่สำคัญกรมสอบสวนคดีพิเศษได้ส่ง ส.ค.1 จำนวน 7 ฉบับ ไปตรวจที่สถาบันนิติวิทยาศาสตร์ กระทรวงยุติธรรม ก็ได้พบว่าเป็นเอกสารปลอมทั้งหมด จึงได้ส่งข้อมูลประสานมายังหัวหน้าอุทยานแห่งชาติสิรินาถเพื่อนำไปประกอบการร้องทุกข์ดำเนินคดีกับผู้ที่ยื่นคำขอออกโฉนดที่ดินทั้ง 5 ราย ซึ่งผู้กระทำผิด ทั้ง 5 ราย ได้ยื่นฟ้องสำนักงานที่ดินจังหวัดภูเก็ต สาขาถลาง ต่อศาลปกครองนครศรีธรรมราช เพื่อให้เจ้าหน้าที่ได้ออกโฉนดให้กับผู้ร้องดังกล่าว อันเป็นการแสดงการยึดถือครอบครองอุทยานแห่งชาติสิรินาถและป่าสงวนแห่งชาติป่าเขารวก-ป่าเขาเมือง โดยมิชอบด้วยกฎหมาย ต่อมาเจ้าหน้าที่กรมสอบสวนคดีพิเศษ สถาบันนิติวิทยาศาสตร์ สำนักงานที่ดินจังหวัดภูเก็ต สาขาถลาง ได้ร่วมกันเป็นพยานต่อศาลจังหวัดภูเก็ต จนในที่สุดศาลจังหวัดภูเก็ตได้มีคำพิพากษา

ให้จำคุก น.ส.อโนมา เป็นเวลา 14 ปี ปรับเป็นเงินจำนวน 9 ล้านกว่าบาท ได้บุกรุกอุทยานฯและป่าสงวนฯเป็นเรื้อที่ 96-2-86.3 ไร่(อ้าง ส.ค.1 เลขที่ 23)  จำคุกนายประภาส เป็นเวลา 12 ปี ปรับเป็นเงินจำนวน 9 ล้านกว่าบาท ได้บุกรุกอุทยานฯและป่าสงวนฯเป็นเนื้อที่ 74-3-4 ไร่(อ้าง ส.ค.1เลขที่ 44)  จำคุกนายประภาส  เป็นเวลา 12 ปี ปรับเป็นเงินจำนวน 9 ล้านกว่าบาท ได้บุกรุกอุทยานฯและป่าสงวนฯ เป็นเนื้อที่ 96-3-45 ไร่(อ้าง ส.ค.1 เลขที่ 45)  จำคุกนายนคร  เป็นเวลา 13 ปี ปรับเป็นเงินจำนวน 9 ล้านกว่าบาท ได้บุกรุกอุทยานฯและป่าสงวนฯ เป็นเนื้อที่ 80-2-73.4 ไร่ (อ้าง ส.ค.1 เลขที่ 32) และจำคุกนายจันทร์  เป็นเวลา8 ปี 8 เดือน ปรับเป็นเงินจำนวน 9 ล้านกว่าบาท ได้บุกรุกอุทยานฯและป่าสงวนฯ เป็นเนื้อที่ 80-0-72.8 ไร่ (อ้าง ส.ค.1 เลขที่ 110) ซึ่งบุคคลเหล่านี้เป็นเพียงตัวแทนของผู้อยู่เบื้องหลังรายใหญ่และกรมสอบสวนคดีพิเศษจะได้ทำการสืบสวนสอบสวนรวบรวมพยานหลักฐานขยายผลเพื่อดำเนินคดีกับผู้มีอิทธิพลรายสำคัญนี้ต่อไป รวมมูลค่าความเสียหายที่ดินของรัฐไม่ต่ำกว่า 15,000 ล้านบาท(ที่ดินมูลค่าไร่ละ ประมาณ 30 ล้านบาท ซึ่งเป็นข้อมูลของกรมสอบสวนคดีพิเศษ)

นายธัญญา เนติธรรมกุล ความสำเร็จในการบังคับใช้กฎหมายในครั้งนี้เป็นความร่วมมือระหว่างกรมอุทยานแห่งชาติ สัตว์ป่าและพันธ์พืช กรมสอบสวนคดีพิเศษ สถาบันนิติวิทยาศาสตร์ สำนักงานที่ดินจังหวัดภูเก็ต สาขาถลาง ซึ่งหากได้มีการบูรณาการในลักษณะนี้อย่างต่อเนื่อง ก็จะสามารถป้องกันและปราบปรามผู้กระทำผิดกฎหมายได้อย่างเด็ดขาด เพื่อรักษาผลประโยชน์ของชาติสืบไป

อย่างไรก็ตามเพื่อการทำงานเชิงรุก อธิบดีกรมอุทยานแห่งชาติฯ ได้มีการลงนามในคำสั่งจัดตั้งสำนักงานตรวจสอบพิสูจน์การถือครองหนังสือแสดงสิทธิที่ดินในพื้นที่ป่าอนุรักษ์เพื่อการดำเนินการตรวจสอบหนังสือแสดงสิทธิในที่ดินที่ออกโดยไม่ชอบด้วยกฎหมายในเขตอุทยานแห่งชาติสิรินาถให้แล้วเสร็จโดยเร็วที่สุด พร้อมทั้งให้อำนาจเจ้าหน้าที่สามารถตรวจสอบเอกสารสิทธิในที่ดินที่คาดว่าน่าจะออกโดยไม่ชอบด้วยกฎหมายในพื้นที่รับผิดชอบของกรมอุทยานแห่งชาติ สัตว์ป่า และพันธุ์พืช ได้ทั่วประเทศ

ด้านพ.ต.ท.ประวุธ วงศ์สีนิล ผู้บัญชาการสำนักคุ้มครองผู้บริโภคและสิ่งแวดล้อม กล่าวว่าในส่วนของกรมสอบสวนคดีพิเศษ ขณะนี้ได้รับกรณีการบุกรุกอุทยานแห่งชาติสิรินาถเป็นคดีพิเศษแล้ว จำนวน 10 ราย 82 แปลง ซึ่งจะได้มีการตรวจสอบและดำเนินคดีตามกฎหมายต่อไป
